Agenda:
Dual Use Technology refers to technology which has more than one use. For dual use companies, developing new ideas and cutting edge innovations are at the core of the work. Hawaii's dual use companies have been successful in winning Federal research funding to develop state-of-the-art technologies. However, Federal research dollars only fund research, and do not fund products ready for the marketplace. Thus, companies fall into an unsustainable cycle of creating research, instead of creating finished products. Sources of "product" funding like those proposed in SB1688 and Act 215 are vital to the commercialization success of Hawaii's dual use companies. SB 1961 RELATING TO BAIL
Creates a licensing requirement for bail bonding agents. Requires the director of commerce and consumer affairs to adopt rules for the process and procedure of obtaining a bail bonding agent license. Prohibits certain acts by bail bonding agents. Provides for civil and criminal penalties for violations by bail bonding agents. Creates registration requirements with the attorney general for bail fugitive recovery persons. Requires the director of commerce and consumer affairs to adopt rules regulating compensated sureties.
SB 1607 RELATING TO CRIMINAL TRESPASS
Repeals the offense of criminal trespass in the second degree that prohibits persons from entering or remaining unlawfully on public property for a specified time period.
SB 1642 RELATING TO LABOR
Amending Sections 89-9(d) by clarifying that certain statutory actions shall not be used to invalidate collective bargaining agreements in effect on and after June 30, 2007 and such actions may be included in collective bargaining agreements.
SB 1662 RELATING TO EMPLOYMENT
Amends definitions of "closing", "covered establishment", and "employer". Requires employer to notify employees of divestiture. Imposes penalties for failure to notify employees of business closing.
SB 702 RELATING TO FIREARMS
Permits owner of a pistol to use any ammunition magazine authorized for use with the pistol by the manufacturer of the pistol. Repeals the prohibition on magazines with a capacity in excess of ten rounds.
SB 1725 RELATING TO OFFENSES AGAINST THE PERSON
Adds violence against emergency medical services personnel to the offenses of assault in the second degree and terroristic threatening in the first degree.
SB 1520 RELATING TO CRIMINAL PROCEDURE
Eliminates requirement that arrest citations contain an offender's full social security number. Authorizes verification of arrest citation and traffic crime complaint by declaration in accordance with rules of court.
SB 1334 RELATING TO NAME CHANGES
Prohibits covered offenders subject to registration requirements from petitioning for name changes.
SB 1571 RELATING TO THEFT
Adds property theft of over $100,000 as a reason to deny probation.
SB 1573 RELATING TO ARSON
Adds recklessness to the state of mind requirement for arson in the fourth degree. Clarifies that 10,000 square feet is only the minimum amount of property damage that is required to trigger special sentencing for arson.
SB 1617 RELATING TO LIMITING CIVIL LIABILITY
Limits the civil liability of property owners to persons injured or killed on premises while committing a class A or B felony or certain violent crimes.
SB 1527 RELATING TO JURORS AND PROSPECTIVE JURORS
Updates and clarifies definitions. Streamlines and affords greater flexibility to the courts to determine the most efficient and effective procedures for selecting, qualifying, summoning, managing, and compensating prospective jurors and jurors. Repeals obsolete provisions.
SB 1635 RELATING TO GRAND JURIES
Shortens the period grand juries and grand jury counsel must serve from 1 year to 6 months. Requires grand jury counsel to be present at grand jury proceedings. Requires grand jury counsel to advise the grand jury whenever the counsel determines it to be appropriate.
SB 1339 RELATING TO THE HAWAII RULES OF EVIDENCE
Allows individuals, corporations, and government entities to offer apologies or other expressions of sympathy without fear of such gestures being used against them to establish civil liability.
SB 470 Proposed SD1 RELATING TO EMPLOYMENT
Requires reasonable suspicion drug testing of public school employees, teachers, and public library employees; requires department of education to adopt rules to determine sanctions for positive drug tests; and establishes employee assistance program. Requires testing for illegal drugs of all elected officials of the State, county, board of education, and office of Hawaiian affairs; disqualifies any person who tests positive for illegal drugs from taking office; and requires forfeiture of office upon testing positive for illegal drugs.

Makes technical amendment to civil service law.

Provides an exception to the confidentiality of mental health records and allows disclosure if it is made by the person's healthcare provider to another health care provider for the purpose of continued care or treatment.
SB 1060 RELATING TO WORKERS' COMPENSATION LAW.
Amends workers' compensation law, including limiting an employer's ability to terminate benefits, authorizing the recovery of attorney's fees and costs by the injured employee, specifying procedures for medical examinations by the employer's physician, establishing fines for violations, requiring the reporting of denials of claims and relevant information, and further restricting the director of labor and industrial relations' rulemaking authority.
SB 770 RELATING TO WORKERS' COMPENSATION.
Excludes from the definition of "employment" under workers' compensation law: service performed by (1) a sole proprietor or a partner of a partnership, as defined in the partnership law, if the partner is an individual; and (2) a member of a limited liability company if the member is an individual and has a distributional interest as defined under the Uniform Limited Liability Company Act, of at least 50% in the company. Provides for fees to be charged under certain circumstances.
SB 946 SD1 RELATING TO ADMINISTRATIVE LICENSE REVOCATION.
Permits driver whose license has been administratively revoked for life to seek reinstatement of the license after 10 years have passed since the occurrence of the lifetime revocation. Requires driver to have had no arrests or convictions for driving while license revoked and to be free from dependency or abuse of alcohol and drugs.
SB 957 RELATING TO PUBLIC WORK PROJECTS.
Clarifies that a single violation refers to each separate project where the department of labor and industrial relations finds a contractor has failed to comply with chapter 104.
SB 1780 SD1 RELATING TO EMPLOYMENT.
Exempts recipients of social service payments from the scope of employment related laws; defines "recipients of social service payments" as it relates to chapters 383, 386, 392, and 393, Hawaii Revised Statutes.
SB 817 SD1 RELATING TO THE I-SAVERX PRESCRIPTION DRUG PROGRAM.
Directs governor to establish the State of Hawaii's participation in the I-SaveRx prescription drug program to provide residents with increased access to affordable drugs.
SB 675 PROPOSING AN AMENDMENT TO ARTICLE VII, SECTION 3, OF THE HAWAII CONSTITUTION, TO CHANGE THE APPOINTMENT OF THE TAX REVIEW COMMISSION TO EVERY TEN YEARS.
Proposes constitutional amendment to require tax review commission to meet every ten years instead of five.
SB 1342 SD1 RELATING TO THE PERFECTION OF APPEALS TO THE TAX APPEAL COURT.
Clarifies that an appeal to the tax appeal court from a board of review decision, or the decision of an equivalent county administrative body, must be served on the director of taxation or county real property assessment division within thirty days of the date of the final assessment to properly confer jurisdiction over the appeal.
SB 784 RELATING TO DRIVER LICENSING.
Provides that conviction or license revocation for violation of provisional driver licensing law does not give rise to requirement that person provide proof of financial responsibility.
SB 785 RELATING TO USE OF INTOXICANTS WHILE OPERATING A MOTOR VEHICLE.
Provides for blood alcohol competent evidence standard for criminal prosecution; requires mandatory sentence of six months to one year if driver has no prior alcohol enforcement contact or drug enforcement contact; requires mandatory sentence for first offense committed by a highly intoxicated driver.
SB 663 SD1 RELATING TO OCEAN RESOURCES.
Authorizes administrative inspections of bags and containers used to carry aquatic life, or vehicles or conveyances to transport aquatic life; repeals the probable cause requirement; directs the department of land and natural resources to create an administrative search scheme.

Allows plaintiff to seek a judicial review of the taking prior to a condemnation action. Requires plaintiff to offer to resell property to defendant for current appraised value or condemnation price plus and cost of environmental remediation or cleanup or other improvements if property taken in eminent domain is not used for the purpose for which it was condemned. SB 1603 SD1 RELATING TO LIABILITY.
Extend certain sunset dates of provisions that provide state and county governments liability protection for public use of certain state or county recreational areas.

Extends statute of limitation for actions against a county for damage or injury from 6 months to 2 years. Permits the counties to identify, by charter, the person to whom claimant should give
notice of claim for injuries or damage sustained on public property or as a result of the negligence of county official or employee.
SB 1392 SD1 RELATING TO ENHANCED PENALTIES FOR SECURITIES VIOLATIONS COMMITTED AGAINST ELDERS.
Adds enhanced civil and administrative penalties for securities violations committed against elders.
SB 1422 RELATING TO SANCTIONS FOR VIOLATIONS BY MORTGAGE BROKERS AND SOLICITORS COMMITTED AGAINST ELDERS.
Provides additional sanctions for violations by mortgage brokers and solicitors committed against elders.
SB 1636 SD1 RELATING TO SUBSTANCE ABUSE.
Amends definition of "substance abuse on-site screening test" to include tests used for forensic testing as a workplace testing device. Requires that substance abuse testing be conducted according to the manufacturer's package insert, as an alternative to the Food and Drug Administration insert if there is no FDA insert.

SB 1339 RELATING TO THE HAWAII RULES OF EVIDENCE
Allows individuals, corporations, and government entities to offer apologies or other expressions of sympathy without fear of such gestures being used against them to establish civil liability.
SB 470 Proposed SD1 RELATING TO EMPLOYMENT
Requires reasonable suspicion drug testing of public school employees, teachers, and public library employees; requires department of education to adopt rules to determine sanctions for positive drug tests; and establishes employee assistance program. Requires testing for illegal drugs of all elected officials of the State, county, board of education, and office of Hawaiian affairs; disqualifies any person who tests positive for illegal drugs from taking office; and requires forfeiture of office upon testing positive for illegal drugs. Appropriates $5,299,809 in general funds for FY 2006-2007, for early intervention services for infants and children from birth to three years of age with developmental delay or at biological or environmental risk for developmental delay.

Clarifies that the Board of Trustees of both the State of Hawaii Deferred Compensation Plan and the State Deferred Compensation Retirement Plan for Part-time, Temporary, and Seasonal or Casual Employees may select and offer participants investment products that are commonly offered in the securities industry or other deferred compensation plans and are determined to the reasonable, prudent investment products.
HB 519 RELATING TO THE STATE DEFERRED COMPENSATION PLAN. Expands the definition of employee under the state deferred compensation plan to include employees who are excluded from participation in the employees' retirement system.
HB 1818 HD1 RELATING TO GOVERNMENT EMPLOYEES. Permits the state and county governments to rehire retirants as permanent employees without affecting the retirants' retirement benefits.
HB 1660 RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Makes adjustments to the Employees' Retirement System.
HB 1292 RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Allows elective officers to exercise their option to join the ERS at any time during their term of office and also allow elective officers and judges to withdraw from ERS membership while remaining in office. Repeals the provisions that make ERS membership by elective officers optional and replaces those provisions with a new section that requires elective officers to exercise a one-time irrevocable option to join the ERS when they are elected for the first time (or, in the case of existing office holders, by February 1, 2008). Sets forth the circumstances under which retirants may return to service as elective officers without suspension of retirement benefits. Repeals the provision that allows elective officers and judges who have reached the statutory cap on retirement benefits to withdraw from ERS membership by nominally retiring even though they remain in office.
HB 1291 RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Allows payment of interest to Noncontributory members who have ERS deductions erroneously made from their compensation. Excludes a "foster child" from being eligible for ERS death benefits if the member dies in service. Allows the ERS Board to set the Chief Investment Officer's salary. Requires excess contributions to be refunded upon retirement, termination or death for judges, legislative officers and elected officials if their retirement allowance exceeds the statutory cap of 75%. Clarifies that Hybrid Plan member contributions that are picked up by the employer are subject to the annual federal income tax limits. Allows post retirement allowances to be paid to beneficiaries who select a monthly annuity instead of the lump sum balance or other clarifying or conforming revisions.
HB 852 RELATING TO THE EMPLOYEE RETIREMENT SYSTEM. Permits all elective officers (rather than only members of the legislature) who attain the age of 65 to retire and receive a service retirement allowance while continuing to fill an elective position.
HB 34 RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Prohibits the employees' retirement system from acquiring securities of companies that have active business operations with Sudan.

Permits calculation of redemption value by container count in certain instances. Allows refusal of refund for previously processed and baled containers. Permits the director of health to suspend an automatic increase of the deposit beverage container fee.
HB 1278 RELATING TO ENVIRONMENTAL SITE CLEANUP. Repeats the sunset date of the Hawaii brownfields revolving loan fund to enable the State to continue to offer low-cost loans to enable eligible borrowers for the cleanup of contaminated properties.
HB 1452 RELATING TO HEALTH. Requires the Department of Health to take soil samples within 500 meters of all military bases in Hawaii to assess for depleted uranium, at least once every 3 months, and annually report to the legislature.
