Governor Lingle's Financial Plan
On January 9, 2009, the Council on Revenues reduced revenue projections for fiscal year 2009, 2010, and 2011. As a result of the revised revenue projections, the projected budget shortfall will increase by about $630 million. This brings the total projected revenue shortfall to $1.8 billion by June 30, 2011 (the end of fiscal year 2011).
Budget Director, Georgina Kawamura, will brief the Joint Committee on the Governor's revised financial plan to meet this revised budget shortfall.

Hawaii Clean Energy Initiative
In January 2008 a Memorandum of Understanding (MOU) was signed between the State of Hawaii and the U.S. Department of Energy. This agreement created the Hawaii Clean Energy Initiative, which seeks to transform Hawaii's energy portfolio into a predominately renewable energy mix, moving away from Hawaii's over-reliance on imported fossil fuels. Under the agreement, Hawaii is positioned to become the testing ground for a portfolio of renewable and efficient energy technologies, pioneering financial, policy, and business models that can be replicated throughout the United States.
Elements of the MOU include: planning for the “structural transformation” needed to help Hawaii develop renewable sources of energy and utilize energy efficiency; fostering financial and policy innovations; supporting public acceptance and awareness of renewable energy technologies; and building a workforce to create and sustain a “clean energy economy.”

Requires the department of land and natural resources to assign priority mooring space to intra-county ferries serving a county with 500,000 or less people and at least three islands inhabited by permanent resident. Exempts proceeds from sale of liquid fuel to intra-county ferry operations from general excise tax. Exempts distributors from fuel tax for fuel sold for ultimate use by the intra-county ferry service.

Requires state and county agencies to ensure that a public right-of-way is available prior to the approval of any development project, subdivision, or zoning change.
SB 468 RELATING TO COASTAL ZONE MANAGEMENT. WTL/TIA
Requires affected agencies to account for sea level rise and minimize risks from coastal hazards such as erosion, storm inundation, hurricanes, and tsunamis. Preserves public access and public shoreline access. Extends shoreline setback to not less than forty feet from shoreline and requires counties to account for annual erosion rates.

Prohibits person or government entity from seizing any firearm or ammunition under civil defense, emergency, or disaster relief powers, or during any civil defense emergency period or any time of national emergency or crisis, from any individual who is lawfully permitted to carry or possess the firearm or ammunition under part I of chapter 134 and who carries, possesses, or uses the firearm or ammunition in a lawful manner. Prohibits suspension or revocation, under emergency powers, of permits or licenses lawfully acquired and maintained under part I of chapter 134.

Authorizes judiciary fees on parolee and probationer's prison transfer applications to be deposited into the probation services special fund. Authorizes full_time coordinator position for the state council for interstate adult offender supervision to be paid from the probation services special fund. Limits expenditure from the probation services special fund to $400,000 every fiscal year.

Clarifies the law with respect to assault against a law enforcement officer.
SB 83 RELATING TO CORRECTIONS. PSM, WAM
Authorizes the auditor to conduct performance audits of private prisons housing Hawaii inmates, namely Red Rock Correctional Center, Saguaro Correctional Center, and Otter Creek Correctional Center.
SB 207 RELATING TO CORRECTIONAL FACILITIES. PSM
Requires the department of public safety to report to the legislature any inmate or correctional facility employee death within 24 hours.
SB 208 RELATING TO PUBLIC SAFETY. PSM, LBR
Repeals exemption from civil service of the first and second deputy sheriff. Effective 01/01/2011.
SB 209 RELATING TO PUBLIC SAFETY. PSM, LBR
Requires the deputy director for law enforcement within the department of public safety to be a graduate of a law enforcement academy or a law school; provided that the requirement shall not be applied retroactively to persons appointed prior to July 1, 2009.
SB 210 RELATING TO CORRECTIONS. PSM, WAM
Clarifies the circumstances under which inmates may be transferred between Hawaii facilities and facilities outside of Hawaii.
SB 211 RELATING TO PUBLIC SAFETY. PSM, WAM
Makes clear that the office of the ombudsman has the authority to investigate facilities that hold Hawaii inmates, appropriates funds to conduct investigations, and makes gender neutral amendments.
SB 212 RELATING TO PUBLIC SAFETY. PSM, JGO
Requires privately owned prisons or out-of-state detention facilities holding prisoners under a contract with the State to follow state freedom of information laws pursuant to chapter 92F, Hawaii Revised Statutes.

Requires the department of public safety to establish performance indicators; requires monthly reports to the legislature, using key performance indicators.

Requires a correctional impact statement be attached to any bill that proposes a change in the law that creates a public offense, significantly changes an existing public offense or the penalty for an existing offense, or changes existing sentencing, parole, or probation procedures.

Requires the Department of Public Safety to develop a plan to use current funding resources to improve community-based programs to assist female offenders in transitioning from prison back into the community.
